I. Legal Basis

As is stipulated in Item 2, Article 2 of the “Regulations on Control of Marriage Registration” (No.387, the State Council), the marriage registration authorities for the registration of marriage between Chinese citizens and foreigners, between mainland residents and residents in the Hong Kong Special Administrative Region (hereinafter referred to as the “Hong Kong residents”), residents in the Macao Special Administrative Region (hereinafter referred to as the “Macao residents”) and residents in Taiwan area (hereinafter referred to as the “Taiwan residents”) and overseas Chinese shall be the civil affairs departments of provinces, autonomous regions, or municipalities directly under the central government or the departments with the authorization of the civil affairs departments of provinces, autonomous regions, or municipalities directly under the central government.

II. Application Requirements

Marriage registration

1. The man shall be at least 22 one full year of life, while the woman shall be at least 20 one full year of life;

2. Both parties shall be single (currently unmarried, divorced or ex-spouse dead);

3. The marriage is based on the willingness of both man and woman;

4. Both parties have no lineal kinship or collateral kinship within three generations;

5. One of the both parties is the permanent resident of Jiangsu;

6. Both men and women shall apply for the marriage in the marriage registration office;

7. Both parties shall have full capacity for civil conduct (without mental disorders and mental disorders).

Divorce registration

1. Having registered marriage in the mainland of China or the Chinese embassies (consulates);

2. Divorce is desired by both parties;

3. Both parties have reached agreement in divorce;

4. Both parties shall have full capacity for civil conduct;

5. One of the both parties is the permanent resident of Jiangsu;

6. Both men and women shall apply for the divorce in the marriage registration office.
